Rental Terms and Conditions

Rental Terms and Conditions

Preamble

These general rental terms and conditions (GTC) govern the relationship between LR LOCATION SARL (hereinafter "THE LANDLORD") and any natural person (individual) (hereinafter "THE LESSEE") who wishes to rent a passenger vehicle or commercial vehicle without a driver.

All drivers must be at least 21 years old and have held a valid driving licence for at least 24 months, corresponding to the category of vehicle rented.

The documents presented must be originals (ID, Passport, Driver's License). Paper copies, scans by email or paper photos or on digital media (phone, tablet) are not accepted.

One or more drivers can be designated in the rental contract, the addition of an additional driver is charged at €30 per designated driver.

2. Acceptance of the GTAs

The reservation or rental of a vehicle implies unreserved acceptance of these GTC.

3. Booking

The reservation can be made online, by phone or in an agency. The TENANT must provide accurate and complete information. A booking confirmation will be sent to the TENANT.

4. Security deposit

The security deposit is a sum deposited by the HIRER in favour of the HIRER by means of a bank pre-authorisation, at the latest when the vehicle is made available, in order to guarantee the perfect performance of the obligations imposed on him.

The amount of the security deposit is indicated on the car rental agreement. Only credit cards are accepted for the payment of the deposit.

The LESSEE must ensure that the limit of the bank card that will be used for the SECURITY DEPOSIT allows for pre-authorization on the day the vehicle is made available. In the absence of a bank pre-authorization, no vehicle will be made available and no refund of the sums already paid will be made.

You must have a credit card in the name of the main driver, with a PIN number and a sufficient margin of expenditure. It is requested to provide the capacity and/or limit of the credit card used for the payment of the deposit. In the event that it is impossible to leave the requested deposit, the reservation will be cancelled, without the possibility of reimbursement by LR LOCATION.

-The deposit by a person accompanying the driver may be accepted and must meet the general conditions of rental in terms of age and license.
-The accompanying person must present his identity document and his driving license. He will then be registered on the rental contract as "other driver" and will have to sign the said contract jointly, thus engaging his responsibility as a roommate.

The amount of the security deposit depends on the category of the Vehicle rented. It is intended to cover the damage suffered by the HIRER due to damage or theft of the Vehicle. The security deposit will be acquired by the HIRER in the event of damage attributable to the HIRER or in the absence of fault of an identified third party and in the event of Theft of the Vehicle, up to the amount of the damage suffered.

The TENANT expressly authorises LR LOCATION to deduct from this deposit any amount for which he or she is due. If the amount of the deposit is insufficient to cover any costs, the TENANT undertakes to ensure payment.

In the absence of any amount due by the LESSEE to the HOST, the security deposit will be returned to him within a maximum period of 8 days from the end of the rental, if necessary in the form of cancellation of the bank pre-authorisation given.

If the amount of the sums due to the LESSOR exceeds the amount of the security deposit, a request for additional payment will be sent to the HIRER by any means.

5. Duration of the rental

The duration of the rental is agreed between the LESSOR and the RENTER. Any extension must be requested and approved by the RENTER. Additional charges may apply in case of extension.

The duration of a rental contract is a maximum of 30 (thirty) days. The LESSEE undertakes to return the Vehicle to the LESSEE on the date stipulated in the rental contract, under penalty of exposing himself to civil and criminal legal proceedings.

If you wish to renew the contract, it will be up to you:

1. To go, with the Vehicle as a priority, to the departure agency
2. To carry out a check of the Vehicle with the agent
3. To pay the rent and additional charges at the end of the expired contract
4. And to sign a new contract.

The renewal of a monthly contract is strictly subject to the foregoing stipulations. In addition, failure by the HIRER to comply with these stipulations for monthly rentals will automatically make him liable to the HIRER for a contractual penalty of 120 (one hundred and twenty) euros including VAT per day of conservation of the Vehicle beyond the expiry date of the contract, in addition to the cost of the rental and without prejudice, for the HIRER, to any civil and/or criminal action that may be available to him on the basis of the non-return of the Vehicle.

In the event that the vehicle is not returned by the return date indicated in the contract, the RENTAL COMPANY will be obliged to file a complaint for theft with the competent authorities.

6. Rates

The rates applicable to the rental are those in force at the time of signing the contract and correspond to the conditions you have set out (duration, place of return, etc.). Any modification of these conditions will result in the application of another rate corresponding to the new conditions.

We invite you to read the table of tariffs in force attached as an appendix.

You must return the rented vehicle in the same state of cleanliness as when you left.
Additional fees will be charged in the event that the rented vehicle is returned "dirty"*
Interior: 50€ (+ 30€ if excessive dirt – grease stains, sunscreen, mud)

*Definition of a "dirty" vehicle: Average state of dirt of the passenger compartment and/or bodywork, non-encrusted dirt and unsoiled support (plastics, fabrics, etc.), dirt that does not require appropriate treatment.

Please check the type of fuel before filling - Fuel error is charged 800€ + fuel price.

The return of the vehicle with a different tank level from the one at the start is charged €30 per missing bar.

Concerning the deterioration of tyres (punctures, crazy tyres, etc.), repairs (material and labour) are the sole responsibility of the customer without the possibility of reimbursement by the RENTAL COMPANY.

The loss of the key is charged 150€ + the price of double the keys.

Any other damage not listed in the appendix will be invoiced at €1,000 or at the expert rate.

SERVICE FEES: Additional fees are charged in addition to any fees charged, these are service fees, these are fees for processing the events invoiced (cleaning, refueling, claim, fine treatment). They can be cumulative. (Cleaning + ticket = 2 X 50€).

The service fee for an event is a flat rate of €50.

7. Insurance

The TENANT is covered by civil liability insurance.

The term "DEDUCTIBLE" refers to the amount remaining at the expense of the LESSEE as not being guaranteed by the insurer (in particular: in the event of damage without an identified third party, in the absence of recourse against an identified third party or damage attributable to the RENTER as well as in the event of theft).

8. Rental Payment Terms.

Payment for the rental is due at the time of pick-up of the vehicle. The HIRER may pay by credit card, cash or any other means accepted by the HIRER. If the payment deadline shown on the invoice by the due date is exceeded, the HIRER will be liable for a late payment penalty on the amount due calculated at the legal interest rate in force plus 10 percentage points.

The LESSEE expressly accepts that non-payment or any non-payment will result in the forfeiture of the term for invoices.

9. Vehicle pick-up – lease start

The vehicle must be collected and returned to the RENTAL COMPANY's counter located at Impasse Léa Bécasse - BOISRIPEAUX - 97139 LES ABYMES.

10. Vehicle condition

A description of the Vehicle is attached to your contract before the vehicle is made available.

The rental period is calculated in increments of 24 (twenty-four) hours, which cannot be split, from the time of availability of the Vehicle, but you have a tolerance of 30 minutes at the end of the rental before a new 24-hour period is applied.

On this descriptive statement, you undertake to record in writing, before your departure from the station, any apparent defect that does not appear therein. Otherwise, we are deemed to have delivered a vehicle that complies with the descriptive statement.

Unfortunately, we will not be able to take into account complaints about apparent damage that was not reported at the time of departure. You must return the vehicle in the condition in which you received it. The vehicle is delivered clean with a full tank of fuel, so it must be returned clean with full fuel.

Upon departure, the LESSEE is invited to make a video of the rented vehicle and keep this proof until the vehicle is returned, however the descriptive condition remains the only document that will be authentic of the condition of the vehicle.

Any repair costs, resulting from a fault on the part of the LESSEE or in the absence of fault on the part of an identified third party, will be added to the cost of the rental.

The scale of fees invoiced when damage attributable to the HIRER is discovered is attached to these terms and conditions and is an integral part of these GTCS of which you ensure that you are aware of when signing the rental and departure contract with the vehicle.

11. Use of the vehicle

You must never drive the Vehicle anywhere other than within the Territory (Territory: Mainland Guadeloupe (except: Marie-Galante/Les Saintes/La Désirade).

You undertake to use the Vehicle in a "prudent manner" and in particular, without being under the influence of alcohol or narcotics or any substance likely to affect driving in accordance with the provisions of the Highway Code and use it in accordance with its intended purpose, which, for a Private Vehicle, is mainly that of the transport of people free of charge and for a Commercial Vehicle, is mainly that of the transport of goods. In the event that the conditions of use of the Vehicle are subject to specific regulations, you are responsible for compliance with these regulations throughout the contract. In addition, any infringement of these regulations obliges the HIRER to compensate the HIRER for any damage that the latter may suffer.

We draw your attention in particular to the dimensions of Commercial Vehicles (shown inside the passenger compartment) which require increased attention when manoeuvring (reversing for example) and may make it impossible to cross certain road infrastructures (tunnels, bridges, etc.), the maximum height of which is, according to the regulations in force, indicated in advance.

WARNING: In the event of a poor assessment of the size of the Vehicle, the upper body and underbody shocks are not covered by the damage guarantee unless the case of force majeure is proven.

You must not use the Rented Vehicle, including:

- To be re-rented
- For the transport of people for a fee
- For the transport of a number of people greater than that mentioned on the vehicle's registration document to participate in rallies, competitions or test drives, regardless of the location
- To give driving lessons
- To push or pull another vehicle (except vehicles equipped with a hook - maximum load 1000 kg)
- On roads that are not suitable for vehicles or where the surface or state of maintenance poses a risk to the tyres or components under the vehicle.
- to commit an intentional offence.

In the event of contrary use, the amount of the deposit is acquired by the RENTER.

The goods and luggage carried in the Vehicle, including their packaging or stowing, must not damage the Vehicle or expose its occupants to abnormal risks.

When you park the Vehicle, even for a short stop, you undertake to lock the Vehicle and to use the alarm and/or anti-theft devices with which the Vehicle is equipped.

You must never leave the Vehicle unoccupied with the keys in the ignition.

Failure to return the keys to the vehicle will result in the forfeiture of the theft cover and your liability may be called into question.

12. Maintenance and mechanical problem - Immobilization

During your rental and depending on the number of kilometres travelled, you will have to carry out the usual checks (engine oil level above 1000 km, tyre pressure, etc.), in accordance with a "prudent" practice. As such, the HIRER will remain vigilant to any signal emitted by the warning lights appearing on the Vehicle's dashboard, if applicable, and will take all necessary precautionary measures, if necessary, such as emergency stop. The Vehicle is supplied with tyres whose condition and number comply with road regulations. In the event of deterioration of one of them for a cause other than normal wear and tear, hidden defects or force majeure, you undertake to replace it immediately and at your own expense with a tyre of the same size, the same type, of equivalent brand, and of equal wear. Non-compliant repairs carried out by a non-professional and immobilizing the vehicle may give rise to an invoice to the HIRER by the RENTAL COMPANY.

In the event of a mechanical breakdown or accident, you benefit from an Assistance Service, included in the price of your rental. Any mechanical transformation or intervention on the Vehicle is prohibited without prior authorization from the RENTAL COMPANY.

In the event that the vehicle is immobilized due to the responsibility of the RENTER, by use contrary to the conditions of Article 11 or by a fault of the HIRER with regard to the engine, accessories (timing belt), components (gearboxes) or tires (flooded vehicle, repairs or modification not authorized or carried out by a non-professional, (camouflage of claim, hidden defect, etc.), daily immobilization fees may be required.

The amount of the fixed asset rate is equal to the daily rate of the vehicle provided for in the rental contract plus €20 per day of immobilization.

13. Responsibilities of the Tenant

The HIRER undertakes to comply with the Highway Code and to use the vehicle in accordance with the HIRER's instructions. The HIRER is responsible for any contraventions and fines incurred during the rental period.

In the event of the LESSEE's Liability covered by the RENTER's insurance

The LESSEE is responsible for the claims covered by the HIRER's insurance company mentioned in the notice given to the RENTER, including in particular:

- any damage caused to the upper parts of the bodywork, the bodywork and the visible mechanical parts.

For invisible parts of the vehicle (oil pan, engine, exhaust, etc.) that are damaged, the fault of the HIRER may also be sought.

Subject to the provisions of Articles 11 and 14 of these GTCS, in the event of theft, the HIRER is covered by the HIRER's insurance company subject to compliance with these GTC and provided that the keys, the vehicle's on-board documents and the certificate of filing a complaint for theft issued by the competent authorities are returned.

In the event of a claim with an identified third party, the LESSEE will then be liable up to the deductible mentioned on the insurance notice given to the LESSEE and applied per claim.

In the event of an at-fault claim, a claim without an identified third party or without the possibility of recourse against an identified third party, in the event of theft, as well as in the event of damage to the vehicle due to the fault of the RENTER, the HIRER will then be liable for the costs incurred for the restoration of the vehicle. (See the renter's repair schedule)

This deductible or these deductibles in the event of multiple claims during the same contract will also be applicable for damage caused to third parties even in the absence of damage to the vehicle.

For each claim, the amount of the deductible will be invoiced to the HIRER at the end of the rental on the basis of supporting documents produced by the HIRER and will be deducted from the amount of the security deposit.

In the event of the LESSEE's Liability not covered by the HIRER's insurance

The renter will be held responsible for interior damage to the vehicle caused voluntarily or involuntarily (breakage of accessories, burns by cigarettes, deterioration by the goods transported, their packaging or their lashing, etc.), unless the HIRER provides proof of his absence of fault.

The HIRER will be held liable for any loss, theft or damage caused to any goods and valuables carried or left by him or any other person on or in the vehicle during the rental period or after the vehicle has been returned. Any costs of repairing the vehicle resulting from a fault on the part of the HIRER will be in addition to the cost of the rental and will be invoiced to the RENTER.

The HIRER cannot be held liable for any loss or damage caused by the HIRER or to any third party by the loading or unloading of the vehicle, including damage caused by a door or the tailgate of the vehicle. Failure to comply with any of the obligations of these General Terms and Conditions will result in the forfeiture of the contractual guarantees and will deprive the HIRER of any insurance coverage of the HIRER.

The vehicle is only insured for the duration of the rental indicated on the rental contract. After this period, the RENTAL COMPANY declines all responsibility for accidents that the HIRER may have caused and which he will have to make his personal responsibility.

The HIRER will be liable for all claims not covered by the HIRER's insurance under the conditions of the common liability law.

All repair costs attributable to the HIRER will be borne by the HIRER and will be in addition to the cost of the rental. The sums due pursuant to this article will be invoiced to the HIRER at the end of the rental on the basis of supporting documents produced by the HIRER, and will be deducted from the amount of the security deposit or will be claimed in addition to the security deposit in the event that its amount is insufficient.

Special case of traffic tickets and fines:

In accordance with the principle of the personality of penalties, you are responsible for offences committed during the duration of the rental. Thus, you are informed that your contact details may be communicated to the competent authorities who request it, you will be liable for a flat-rate service fee for the processing of the file amounting to 50 (fifty) EUROS.

The LESSOR will do its utmost to contact the HIRER with the contact details indicated in the rental contract (email address and telephone) and inform him/her of the receipt of a fine.

The HIRER expressly authorises the HIRER to use their means of payment, in particular a bank card, to be paid the corresponding amount, under the conditions of the article

14. Accident – Theft – Joint accident report

The HIRER is responsible for the Vehicle in his or her care. In the event of an accident, with or without an identified third party, the HIRER must fill in an accident report of motor vehicle accident and submit it within a period not exceeding 5 (five) working days to the vehicle recovery agency.

In the event of Theft, you must send the LESSOR the theft declaration receipt issued by the Authorities, within 2 (two) working days, as well as the keys and papers of the Vehicle if they are in your possession.

Otherwise, and if the RENTAL COMPANY is implicated by an opposing insurance company, then you will be liable for the processing fee of 150 (one hundred and forty-three point fifty-two) euros including VAT. In any event, you will be liable for a processing fee of 90.00 (ninety) euros including VAT, reimbursable in the event that you are not held liable. In the event of theft of the Vehicle or damage caused to it by your fault, or in the absence of fault on the part of an identified third party, you must compensate the RENTAL COMPANY for the damage. (Amount estimated by an expert of the foreseeable cost of the repairs, or market value of the Vehicle, if applicable, immobilization costs, administrative fees, etc.).

At the end of the rental, in the event of damage or theft, an amount equivalent to the excess will be invoiced to you. If the amount of the damage actually suffered by the vehicle is higher than the amount of the excess, an invoice for the difference will be sent to you. If the damage suffered by the RENTAL COMPANY were to be reduced (discovery of the vehicle within 60 days, sharing or total liability of a third party, etc.), the RENTER(s) would be reimbursed up to this reduction.

15. Return of the vehicle – end of the rental

The rental ends with the return of the Vehicle, its keys and papers to the RENTAL COMPANY's counter. In the event that the Vehicle is returned without its keys, these will be invoiced to the HIRER and, if applicable, the costs of repatriating the Vehicle. The RENTAL COMPANY cannot be held responsible in any way for goods that have been forgotten in the Vehicle at the end of the rental.

The HIRER must ensure that the vehicle is in the same condition as when it was picked up, subject to normal wear and tear.

Only the taking possession of the Vehicle, documents and keys by the LR LOCATION agent, during the opening hours of the agency concerned, allows the rental contract to be terminated. Your responsibility is engaged until the end of the rental contract.

In the event of a return of the vehicle outside the opening hours of the LR LOCATION agency, or if the return of the vehicle is carried out outside the agency (the vehicle is left in a car park), the LESSEE is responsible for any damage suffered (loss of keys, etc.), in addition to the repatriation of the vehicle will be invoiced to the RENTER at a flat rate of €50, in zone 1 (LES ABYMES, MORNE A L'EAU, LE GOSIER, POINTE A PITRE, BAIE MAHAULT) and €70, in zone 2, i.e. municipalities outside zone 1.

Exceptions: in the event of confiscation or sealing of the Vehicle, the rental contract may be terminated by operation of law as soon as the LESSOR is informed by the Authorities or by the RENTER. Any use of the Vehicle that would be detrimental to the LESSOR would authorise the latter to terminate the contract by operation of law. In the event of Theft, the rental contract is terminated as soon as the HIRER has filed a complaint with the competent authorities to the LESSOR. In the event of an accident, the rental contract is terminated as soon as the HIRER and any third party have sent the LESSOR the joint report duly completed by the HIRER and any third party.

The rental period provided for in the contract is binding on the LESSEE, in the event of early return by the HIRER no discount is due by the LESSOR for delivery before the end date of the rental.

To obtain a full refund, the cancellation must be made at least 7 (seven) days before the rental start date.

For a change in the rental dates after booking, it is possible at most 7 (seven) days before the start date of the rental to change the start and end dates of the rental, the number of rental days remains the same as the reservation, failing this, the RENTAL COMPANY reserves the right to refuse the modification of the reservation and to proceed with the refund of the deposit paid.

No refund of the deposit may be requested by the TENANT in the event of non-compliance with the rental conditions: problems encountered with the credit card, lack of bank guarantees or presentation of the required documents.
